Welcome to Thumbnail Plus. These Terms govern your use of the ThumbnailPlus platform, website, mobile/web apps, and related services (the "Service"). By using the Service you agree to these Terms.

1. Definitions

• You / User: anyone accessing the Service.
• Content: thumbnails, images, text, scores, or material generated, uploaded, or displayed via the Service.
• Access Pass / Paid Plan: a one-time prepaid plan granting time-limited premium access (1 month / 1 year) with no recurring auto-billing.
• AI Services: third-party AI APIs used for generation/analysis (including Google Gemini and OpenAI).

2. Eligibility

You must be at least 13 (under-18s need parental/guardian consent) and provide accurate registration info. You represent you meet these requirements.

3. Account Registration & Security

• Sign-in is via Google Sign-In. You're responsible for your credentials and all activity under your account.
• No account sharing or unauthorized access; report misuse immediately.
• We may suspend/terminate violating accounts.

4. Service Description

• AI Generation: thumbnails from your descriptions, styles, and preferences.
• AI Grading: clickability scores (0–100) with feedback.
• A/B Comparison: side-by-side analysis with an AI verdict.
• Sharing: templates/tools for social sharing.

5. Usage Limits & Fair Use

• Starter (Free): 2 generations, 5 gradings, 2 comparisons — once-in-a-lifetime trial, watermarked.
• Creator pass: 25 generations, 60 gradings, 15 comparisons per 30-day period.
• Pro pass: 50 generations, 100 gradings, 25 comparisons, 10 custom style profiles per 30-day period.
• Automated/scripted abuse or circumvention may lead to suspension.

7. Intellectual Property

Your content: subject to your pass terms, you retain ownership of generated thumbnails (free tier includes a watermark). You grant us a non-exclusive, worldwide, royalty-free license to process uploads solely to provide the Service. Our design, code, branding, and technology remain ours — no copying, modification, or reverse-engineering.

8. Prohibited Uses

• Illegal, harmful, harassing, defamatory, obscene, or infringing content.
• Circumventing limits/watermarks; bots/scripts; resale or sublicensing.
• Deceptive, misleading, or fraudulent content; interfering with Service integrity/security.

9. Payments & Access Passes

• Prepaid 1-Month (30 days) / 1-Year (365 days) passes in localized currency (INR, USD, EUR, GBP, AUD, CAD).
• No auto-renewal — passes never rebill automatically.
• Processed securely by Razorpay (their terms also apply). You're responsible for applicable taxes.

10. Pass Expiration

Full premium access lasts the whole validity period. Afterwards the account reverts to Starter; gallery items remain accessible; new free generations are watermarked. Buy a new pass anytime to restore premium.

11. Limitation of Liability

To the maximum extent permitted by law, Thumbnail Plus isn't liable for indirect, incidental, special, consequential, or punitive damages (including lost revenue/profits/data). Total liability is capped at amounts you paid in the 12 months before the claim.

12. Third-Party Services

Google (Gemini, Firebase, Sign-In), OpenAI (DALL·E, GPT-4o), Razorpay — their terms apply. We're not responsible for their availability/accuracy/performance.

13. Termination & Deletion

We may suspend/terminate access for violations, fraud, or abuse. You may delete your account anytime: Settings → Edit Profile → Delete Account & Data. See deletion instructions. Refunds follow the Refund Policy.

14. Governing Law

Laws of India; exclusive jurisdiction of courts in Delhi, India. Parties attempt good-faith negotiation for 30 days before proceedings.

15. Changes to Terms

Material changes communicated via email/in-app at least 15 days before effect; continued use = acceptance.
